HP pursues $4B in damages from household of departed tech billionaire Mike Lynch

Just 2 weeks after Mike Lynch and his child Hannah passed away in a superyacht mishap off the coast of Sicily, Hewlett Packard Enterprises has actually pledged to push ahead with a high court claim versus the household of the late British tech business owner.

The Silicon Valley giant stated in a declaration it would follow the legal procedures “through to their conclusion.” The company is looking for damages of approximately $4bn.

HP’s case relates to its $11bn acquisition of Lynch’s start-up, Autonomy, back in 2011. Following the offer, HP implicated Autonomy’s management of fraudulently pumping up the business’s worth, resulting in a 12-year legal fight.

In June, Lynch was acquitted on all charges in a San Francisco court. He still wasn’t entirely off the hook. In 2022, HP won a different case versus Lynch in the UK that is still continuous.

A last judgment is anticipated quickly, although the judge managing the case composed in 2022 that he anticipated last damages to be “significantly less” than the $4bn HP looked for.

Will HP actually pursue Lynch’s widow?

Lynch’s widow, Angela Bacares, was amongst fifteen others that made it through the sinking of the superyacht, the Bayesian, in the early hours of August 19. The widow might now be responsible for the damages declare made versus her partner.

Benson Varghese, a United States criminal defence lawyer, informed TNW that while HP is “lawfully warranted,” the tech business “should think about the ethical and reputational ramifications of such a relocation.”

“If HP chooses to drop the claim, it may prevent unfavorable promotion and align itself as a thoughtful entity. On the other side, stakeholders may see this as a failure to promote their fiduciary obligations. It’s a tightrope walk.”

“But it’s a fragile balance,” he continued. “In the courtroom of popular opinion, compassion can typically weigh more than legal rightness.”

Lynch was holidaying in Sicily enjoying his newly found flexibility when catastrophe struck. Italian and British authorities are presently examining what triggered the Bayesian– which one boat specialist called “unsinkable”– to plunge to the depths of the Mediterranean in a matter of minutes. Some reports recommend that the boat might have been struck by a waterspout, breaking the mast and triggering the vessel to capsize.
